Kinemetrica Inc. warrants that during the warranty period, it will, at its sole discretion, remedy defects free of charge either by 1) repairing the Product, or 2) replacing the Product, or 3) refunding the purchase price of the Product to the original purchaser, subject to the terms and conditions of this Limited Warranty. Any replacement Product may be, at the option of Kinemetrica Inc., a new or remanufactured Product. This Limited Warranty is only valid and enforceable in the country of purchase. The warranty period starts at the date of original purchase. Kinemetrica Inc. provides the following product warranties:
Command Trakker Baseball Hardware Products: (1) one-year limited warranty for the device.
Exclusions and limitations: This limited warranty does not cover:
Normal wear and tear of the product.
Defects or damage caused to the product by misuse (contrary to intended or recommended use with the documentation), accident (including without limitation: impact, collision, fire , rain , water, the spillage of food or liquid), neglect, abuse, alteration, unusual stress, modification, improper or unauthorized repair, installation, wiring, or testing, improper storage, or if the serial number has been removed.
For sake of clarity, misuse also includes: device damaged after being hit by anything other than a regulation size and weight baseball, device damaged after being hit by a baseball bat, device dropped, device used under rain, snow, or water exposure conditions. Device used under excessive heat above 100 degrees fahrenheit. Misuse also means cleaning the target with chemicals or abrasives.
Access to warranty service: You must have proof of purchase to access Kinemetrica Command Trakker warranty service. To obtain warranty service for any product that is subject to the foregoing warranty, you must notify Kinemetrica Inc. and request to obtain a Return Material Authorization (“RMA”). If Kinemetrica Inc. determines that the product is covered under warranty, Kinemetrica Inc. will send you detailed information about how and where to ship the product.
Use the provided RMA information to return the defective product with proof of purchase (unless otherwise specified upon reception of the RMA)
Consumer shall bear the cost of shipping the product to Kinemetrica Inc. and Kinemetrica Inc. shall bear the cost of shipping products that are under warranty back to the consumer after the completion of service under this limited warranty. Any product returned to Kinemetrica Inc. without an RMA or without proof of purchase will be returned to the consumer at the consumer’s cost.

Limited liability: The limited warranty extends only to the consumer and is not assignable or transferable to any subsequent purchaser or user.
The limited warranty set forth above is provided in lieu of all other warranties and Kinemetrica Inc. hereby disclaims all other warranties of any kind, whether express, implied, statutory or otherwise, including without limitation any warranties of merchantability, fitness for a particular use or purpose, non-infringement, quality and title. Kinemetrica Inc. does not warrant that the product is error free or that it will function without interruption.
To the extent Kinemetrica Inc. may not, as a matter of applicable law, disclaim certain implied warranties, the duration of any such implied warranty shall be limited to the shorter of the one (1) year limited warranty period or the minimum time period permitted under such law. Some states do not allow limitations on the duration of implied warranties, so the above limitation may not apply to you. This limited warranty gives you specific legal rights, and you may also have other rights that vary from state to state.
In no event will Kinemetrica Inc. be liable for any special, indirect, incidental, punitive or consequential damages of any nature whatsoever including but not limited to loss of profits or revenues, loss of data, loss of use of the product or any associated equipment, cost of any replacement goods or substitute equipment, loss of use during the period that the product is being repaired, claims of any third parties, or any other damages arising from Kinemetrica Inc.’ breach of this limited warranty or the use of the product, regardless of the form of action whether in contract, tort (including negligence) or any other legal or equitable theory, even if Kinemetrica Inc. has been advised of the possibility of such damages. in no event will Kinemetrica Inc.’ total cumulative liability exceed the price paid by the consumer for the product.

Kinemetrica Inc. hardware products are sensitive and accurate data-tracking monitors. While Kinemetrica Inc. hardware has been engineered to achieve accuracy within a regular baseball environment; exposure of Command Trakker to water, snow, or any wet or damp environments must be avoided or warranty will be voided. Your Command Trakker target is not water-resistant. Do NOT use the device under rain, water exposure or wet environments, as the product may get damaged.
